Terms and Conditions of Sale

  1. General Information
    1.     The sale of “SOGNARE” products (“Products”) through the website www.sognarefashion.com (“Website”) shall be governed by these Terms and Conditions of Sale (“Terms and Conditions”). The persons who are willing to place an Order through the Website are required to carefully read these Terms and Conditions.
    2.     These Terms and Conditions may be amended or updated by SOGNARE at any time. In case of any amendment, the new version of the Terms and Conditions shall be made available on the Website. Customers shall be subject to the Terms and Conditions that are valid at the date the Order is submitted.
    3. The Products on the Website are sold by GPCC Europe Leather and Textile Limited Co. (“SOGNARE”), a company located at Firenze FI, Liberta Viale Giacomo Matteotti 15, 50121 Florance, Italy. 
    4. The sale of Products through the Website is only available to natural persons (“Customer(s)”) who are: (i) end-users, (ii) over the age of eighteen (18) years and (iii) capable of concluding a legally binding contract. Any Order placed by an individual under (18) years of age will not be processed by SOGNARE.
    5. Products displayed on the Website will be made in order and personalized based on the Order to be placed by the Customer. Therefore, the purchase of Products must only be made for personal purposes. The sale of Products is restricted for business or professional purposes (e.g. resale by the Customer to third parties). 
    6. SOGNARE reserves the right not to accept and process Orders from any person who does not comply with the conditions stipulated in 1.4. and 1.5. above.

2. Products

2.1.  The Products displayed and sold through the Website are exclusively personalized. Each Product ordered by a Customer is exclusively produced by SOGNARE for the related Customer, based on the size and other personal requests provided by the Customer. 

2.2.    Information on the Products, including their unit prices, photographs, colors and sizes shall be available on the Website. The photos and colors of the Products displayed on the Website, may be different than the actual Product, due to the technical characteristics and color resolution of the Customer’s computer or other device used by the Customer to visualize the Product. SOGNARE may not be hold responsible for any discrepancy caused by the above-mentioned reason, between the actual product delivered to the Customer and the Product seen by the Customer on the Website.

2.3.    Customers acknowledge that SOGNARE is entitled to change the type, style and colors of the Products displayed on the Website at any time without notice. If any Product ordered by a Customer is unavailable, SOGNARE will inform the Customer promptly, from receipt of the Order by SOGNARE. In this case, the Order placed by the Customer will be cancelled.

2.4.     The Customer may purchase maximum 5 pieces of each Product. SOGNARE reserves the right not to accept and process any Order exceeding the order limit mentioned in this provision or if it is suspected that the Order has been placed for resale/business purposes and/or is fraudulent.

 
3. Purchasing Process

 

3.1.     Prices of the Products are quoted on the Website in U.S. Dollars. The prices displayed on the Website are inclusive shipping and delivery costs, and exclusive applicable taxes. The total price indicated in the Shopping Bag displays estimated taxes. The Customer acknowledges that the actual taxes may vary from the estimated taxes indicated on the Website and the actual taxes will be borne by the Customer.

3.2.    SOGNARE is entitled to change the prices of the Products displayed on the Website, at any time and without notice. Nevertheless, SOGNARE guarantees that, for all Orders, the price displayed on the Website at the time the Order was confirmed by SOGNARE, will be the price to be applied to that Order (except for customized Orders requiring the calculation of the price by SOGNARE in consideration of the customization and/or other personal requests of the Customer).

3.3.    Payment can be made by direct wire transfer or by credit card.

SOGNARE accepts credit card payments made with:

Visa, MasterCard, American Express and Union Pay.

Discover, JCB (Japan Credit Bureu), MIR (Rusya), TROY, KNET (Kuveyt), MADA (Saudi), Benefit (Bahrain)

Online Savings Transfer Systems:

Online Payment Systems:

3.4.     Each Order will be deemed to have been completed and the transaction will be charged to the Customer’s credit card, after verification of the Customer’s  credit card data and authorization to charge the Customer’s credit card has been given by the bank which issued the card. If the Customer’s credit card cannot be verified and the required authorization is not given by the bank, the Order will be cancelled and will not be executed by SOGNARE.

3.5.   An Order Confirmation will be sent to the Customer’s e-mail address after completion of the process described in 3.4. above. The Customer will not be entitled to cancel the Order, after the Order Confirmation is sent by SOGNARE.

3.6.    Orders accepted and confirmed by SOGNARE will be shipped through UPS delivery service. Deliveries will be made Monday through Friday, excluding Saturdays, Sundays and holidays.

3.7.   The invoice concerning the Product will be sent to the Customer by e-mail and/or mail.

4. Delivery

4.1.    The estimated time of delivery will be indicated in the Order Confirmation. In case of any change in the estimated delivery time, SOGNARE will inform the new estimated delivery time to the Customer by e-mail.

4.2.  Delivery of the Product(s) will be made to the address indicated by the Customer in the Order. The Customer is responsible of providing a valid, accurate and correct address for delivery to SOGNARE. No shipment will be made to an address only indicated as a P.O. Box. In this case, the Customer will be asked to provide a full address prior to shipment. Any delay arising from the inaccuracy of the address provided by the Customer or any other reason that is beyond SOGNARE’s control shall not be the responsibility of SOGNARE.

4.3.    The Customer is required to examine and verify that the Product’s package is not damaged at the time of delivery.

4.4.    Special Exclusive Delivery shall be available upon the Customer’s request to be sent to: [email protected]. Special Exclusive Delivery shall be personally made to the Customer by the special delivery agents of SOGNARE. Special delivery costs shall be borne by the Customer.

5. Warranty and Product Liability

5.1.  All Products of SOGNARE are exclusively personalized and made-to-order. Therefore, unless otherwise is specified in these Terms and Conditions, any Product purchased by a Customer is nonrefundable and may not be returned by the Customer to SOGNARE. Customers are asked to carefully examine the images and description of the Products on the Website and to give their size and body measurements correctly when placing an Order.

5.2.    SOGNARE does not accept any claim or liability with regard to any Product, except for manufacturing defects that are definitely determined, as stipulated in these Terms and Conditions. In case of any allegation based on a manufacturing defect, the Customer will be required to immediately send an e-mail to [email protected] The Customer must explain the reason of the allegation and also send photographs of the alleged defect together with the claim.

If, upon the examination performed by SOGNARE, it is determined that the Customer’s allegations are true, SOGNARE will either repair the Product or replace it with a new one. The costs of repair or replacement will be borne by SOGNARE.

5.3.    If, it is determined that, the defect alleged by the Customer is not caused by manufacturing or the Product is damaged due to a reason attributable to the Customer, SOGNARE will repair the Product upon the Customer’s request to be sent to the e-mail address mentioned in 5.2. above. In this case, the costs of repair and any costs relating to the delivery to the Customer shall be borne by the Customer.

6. Alterations

SOGNARE runs a control mechanism before processing any order. This control mechanism is a general control mechanism to compare the given sizes in any order with a standart human size. The sizes which are beyond standart margins are sent to our tailors for additional control. In such case, SOGNARE may contact the Customer to control the given sizes of the Order.

Please note that bespoke, custom and made to order items are not eligible for alterations. Therefore SOOGNARE show uttermost attention to process any Order with the correct sizing information. However, in case there is a need of resizing / alteration, this service may be provided by SOGNARE as long as the alteration does not effect the originality of the Product. Please note that this service may incur a fee.

7. Intellectual Property Right

“SOGNARE” trademark, as well as all images, photographs, content, models, designs, illustrations and other intellectual property rights in relation to the Website and the Products form the worldwide exclusive property of SOGNARE.

8. Applicable Law and Settlement of Disputes

These Terms and Conditions shall be governed by Italian Law, and in particular by Italian legislative decree no. 206 of 6 September 2005 on distance contracts and by Italian legislative decree no. 70 of 9 April 2003 on certain aspects related to e-commerce.
